These terms and conditions (hereinafter “Terms and Conditions”) apply to the access and use of the Website, and to any Order, sale and purchase of any and all milia m products (hereinafter the “Products”) featured on thisWebsite. By placing an order of the Products (the “Order”),you are offering to purchase a Product and you are deemed to understand and unconditionally accept the application of these Terms and Conditions.

We reserve the right to revise and amend these Terms and Conditions at any time, in our sole discretion, without any prior notification, effective immediately as of the date of publication of the revised Terms and Conditions on this Website. Please check this page regularly to ensure you are familiar with the current version of these Terms and Conditions. The continued use of the Website shall be construed as acceptance of the revised Terms and Conditions.

  1. ELIGIBILITY AND TERRITORY

  2. The use of the Website is reserved for persons aged 18 years old or above. By accepting these Terms and Conditions, you confirm that you are 18 years old or above.

    Access to sales of Products via this Website is exclusively reserved to residents in Europe and GCC (“the Territory”). We shall not deliver an Order outside the Territory via the Website.

  3. ORDER PLACEMENT

  4. By placing an Order, you are offering to purchase a Product on the Website. All Orders are subject to availability and confirmation of the Order price. milia m reserves the right to refuse any Order or any request made by you, at its sole discretion.

    2. To place an Order, you must identify yourself by creating or logging into an account.You represent and undertake to provide true, accurate, current, and complete information about yourself.

      If you use the Website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password.

    3. CONCLUSION OF TRANSACTION

    4. Once the Order is completed, you will receive an e-mail of confirmation. As of reception of the confirmation email, the purchase shall be deemed completed for said Products. You must verify as soon as possible the contents of the e-mail and notify us of any eventual error or omission.

    5. FOLLOW-UP

    6. A confirmation email will be sent to you once your Order has been shipped, which will include the tracking number of your shipment.

    7. ACCURACY OF CONTENT

    8. While we strive to ensure that all details, descriptions and prices of Products appearing on the Website are as accurate as possible, it is probable that there are minor discrepancies between the images and the actual Product (notably the colors appearing on the Website, as they depend on the monitor). We cannot guarantee that the Products will be identical to the images displayed on the Website, and milia m is not liable for any minor discrepancies between the Products image and the final delivered Products.

      All sizes and measurements are approximate; however we do make every effort to ensure they are as accurate as possible.



      All Products are quality controlled and checked for any faults before they are shipped to customers. If you are not completely satisfied or if there is a discrepancy with your Order or if you receive a Product that is not in perfect condition, please retain all documentation/packaging and contact the Customer Services Team immediately by sending an email to customercare@miliam.com (for more details, please see Returns and Exchange).

    9. AVAILABILITY AND CANCELLATIONS

    10. While we strive to ensure all Products featured on the Website are available, we cannot and do not guarantee availability of the Products. We reserve the right to limit availability of the Products at our sole discretion.

      If your Order is out-of-stock, we have no obligation to provide you with the related Products, and in such cases:

          - We will cancel your Order if its entirety is out-of-stock.
          - We will contact you if part of your Order is out-of-stock.

      We will inform you in case your Order is part or entirely backordered. milia m is not responsible for delays in your Order due to backorder or out-of-stock situations. Shipments will only be made when all Products in your Order have arrived at the warehouse.

  5. PRICES AND PAYMENT

    2. While we try to ensure that the featured prices of the Products on the Website are correct, we are unable to guarantee any absence of errors. In the event of an error in price, we will allow you the option to reconfirm the purchase of the Product within the correct price or to cancel the Order. If we are unable to contact you, the Order will be deemed cancelled. We have no obligation to sell a Product based on a wrong price, even if the overview of the Order has already been sent to you. The Product price is mentioned on the website in USD, and does not include applicable taxes, duties, etc…applicable at the destination country.

      The cost of the Products may fluctuate. All prices advertised are subject to such changes. Shipping and handling fees are not included in the price.Your total price, including shipping and handling, as well as Insurance, will be provided upon checkout.

    3. CURRENCY

    4. All transactions are in United States Dollars. Your credit card, or bank statement however will show our charge in your local currency. The dollar amount in your invoice will be converted to your local currency on the day that you make your payment. If the Website provides for a currency conversion tool, such tool is only meant to give you an estimate for your convenience only, and is in no way a guaranteed rate.

    5. DUTIES AND TAXES

You are responsible for the payment of VAT (if applicable) as well as for the payment of all applicable duties and taxes in the destination country. milia m is in no way responsible or liable for any and all entry taxes, duties, customs fees or any other duties and taxes. If you refuse or are unable to accept delivery of your shipment due to duties or taxes due to local restrictions regarding the importation of the Products, or return to milia m said shipment, you will be held liable for return shipment and all other fees incurred by milia m in connection with the return.

    7. ADDITIONAL/OUT OF CONTROL CHARGES

    8. We are not responsible for any additional charges by your local bank or Credit Card Company.

    9. PAYMENT METHODS

    10. The ownership of the Products is transferred to you only upon full payment of the total price.

      We only accept the following credit or debit cards to place Orders on our Website:

      • Mastercard
      • Visa
      • American express
      • When placing an Order, you represent and undertake that all details you provide are true and accurate, that you are an authorised user of the credit or debit card used to place your Order and that there are sufficient funds to cover the cost of the Products.

      For security purposes, the name and billing address must be identical to the name and billing address of the card used to place the Order. milia m reserves the right to cancel all Orders which do not fulfill said criteria, as well as refuse or cancel all Orders at its sole discretion.

  6. SHIPPING AND DELIVERY

    2. milia m only delivers within the Territory. milia m reserves the right to restrict or expand the Territory at any time, at its sole discretion.



    3. SHIPPING AND HANDLING FEE

    4. Our shipping and handling fees are combined on your Order and are automatically calculated by our system depending on how many items are in your Order. Prices vary per weight and per country. Shipping and Handling fees are calculated upon checkout. Your total, including shipping and handling, in addition to insurance, will be provided before you submit your Order.

      milia m insures each purchase, against loss or damage, from the time it is in transit until it is delivered to you. The shipping and handling fees include costs for insurance of your Order.


      *The above prices do not include cost of insurance.
      *Insurance cost: 15$ minimum or if purchase is over 500$, the cost will be 3% of total price of purchased items

    5. INTERNATIONAL SHIPPING AND TRANSIT TIMES

    7. DELIVERY

    8. Products will generally be shipped from our warehouse within 48 hours (during working days) after the confirmation of the availability and support of the Order. Orders will be shipped from Monday to Friday, except public holidays and national holidays.

      Except in case of a Force Majeure Event (as defined herebelow), the Products are usually delivered within 2 to 20 working days from the date of confirmation of the Order.milia m shall not accept deliveries to PO Boxes, and reserves the right to refuse to process said Orders.

    9. TIME OF DELIVERY

    10. At the time of delivery, we require a signature for any Products delivered, at which point responsibility for purchased Products passes on to you. The recipient must be an adult of 18 years of age or above. If you have specified a recipient other than yourself for delivery purposes, then you accept that evidence of a signature by them, or at that delivery address, is evidence of delivery by milia m and transfer of responsibility in the same way.

      The recipient should verify that: (i) the number of packages delivered corresponds with the information of the delivery slip, (ii) that the packaging is intact, not damaged, or wet or altered in any manner, including the materials used for closing the package. Any damage to the packaging and/or Product, any error in the number of packages or non-compliance of directions, should be immediately contested by the recipient by writing a reserve of control on the delivery slip.

    11. DELIVERY DELAYS

    12. In the event any or all of the ordered Products are not delivered within a maximum 30 days period as of the date of confirmation,the Customer Service Team shall contact you and coordinate with you in Order to ensure full client satisfaction.

      milia m shall not be held liable in the event the delivery delays are caused by a Force Majeure Event, or in the event of refused or abandoned shipments as detailed hereinafter.

    13. REFUSED/ABANDONED SHIPMENTS

    14. You will be held liable for all return shipping fees, duties and taxes (if incurred), and for all other associated fees when any of the following circumstances occur:

          - You refuse delivery of your Products for any reason whatsoever.
          - The carrier makes 3 unsuccessful attempts to deliver your parcel to your address because you are not at home and/or do not pay duties and taxes.
          - You provided an invalid address.
          - The Product(s) is/are detained or refused entry at customs in accordance with local applicable customs regulations.

  7. RETURNS AND EXCHANGE

    1. RETURN POLICY

    2. We do not accept returns for items purchased at other retail locations or other websites.

      In the event that the Products received are defective or not the Products ordered, you are entitled to an exchange or a refund as detailed below.

    3. GIFTS

    4. If you request the Product be delivered to a third party, you are responsible for the return of the Product. The gift recipient may not return the Product.

    5. RETURNS PROCEDURE

    6. In the event you request an exchange or a refund, you must fulfill the following conditions:

      • Within 14 days of receiving your order, sign in to your account and fill the return and exchange form to request a size and color change or a refund.
      • Once the Return or Exchange has been approved by milia m. Customer Care will send you a Return and Exchange Authorization Slip by email.This Slip should be added to the returned/exchanged Products (Return Package).No refunds or exchanges will be given on Products returned without an approved Return Authorization Slip.
      • Return Packages must be shipped to the address indicated on Return Authorization Slip.
      • Return Packages must be postmarked no later than 21 days from date of original purchase.
      • Return Packages must be sent through DHL, as indicated by the Return Authorization slip, which will allow milia m to determine at any time the location of the Return Packages.
      • All tags, including the price tag, must be fully attached to returned items. All items should be returned in their original, undamaged packaging. We do not accept returns on items that have been worn, altered, washed, or damaged in any way.
        The Products are returned at your sole risk and responsibility. We shall not be liable for reimbursement or compensation in the event that a Return Package is lost, stolen or mishandled. We reserve the right to refuse any Return Package that does not meet the above return requirements at our sole discretion. After reception and control by milia m to make sure the above-mentioned Returns Procedure is fulfilled, you will receive an email confirming the acceptance of the return of the Products. You must keep all proof of return.


    7. REFUND

    8. Regularly priced merchandise may be returned for a full refund within the return time period as stated above. Discounted merchandise cannot be refunded, only exchanged.

      If you request a refund, you will be refunded for the merchandise purchase price, minus original or return shipping charges and insurance, your refund will not be issued until the Return Package is accepted.

      The returned Product will be refunded to you within a maximum period of 30 days starting from the acceptance of the Returned Package by milia m. The refund amount will be credited to the same card account that was used by the client to pay for the transaction. Please note that it may take up to ten business days for your refund to be processed.

    9. EXCHANGE

    10. If you request an exchange, you shall be liable for all shipping fees to/from our warehouse, we will bill you via your original payment method for any additional charges incurred.

  8. DISCLAIMER FROM UNFORESEEABLE CIRCUMSTANCES

  9. milia m is not responsible or liable, nor shall it be deemed in default of these Terms and Conditions, for any delay or failure in performance or non-performance of any aspect of these Terms and Conditions resulting directly or indirectly from force majeure event such as any accidents, fires, electrical or electronic failures, equipment failures, shipping delays from either online retailers, international couriers, or others, acts of God, labor disputes, governmental orders or regulations, or any other cause beyond the reasonable control (“Force Majeure Event”).

  10. DISCLAIMER OF WARRANTIES

This Website and/or application is provided by milia m on an "as is" and "as available" basis. milia m makes no representations or warranties of any kind express or implied, as to the operation of this site and/or application or the information, content, materials, or products included on this site. You expressly agree that your use of this Website and/or application is at your sole risk. To the full extent permissible by applicable law, milia m disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. milia m does not warrant that the Website, any information, content, materials, products or services included on or otherwise made available to you through the site, our servers or e-mail sent from milia m, are free of viruses or other harmful components or are otherwise fit for any particular purpose. milia m does not warrant that the functions contained on the site will be uninterrupted or error-free, or that defects will be corrected. milia m shall not be liable for any damages of any kind whatsoever arising from the use of the site or from any information, content, materials, products or services included on or otherwise made available to you through the site, including, but not limited to direct, indirect, incidental, punitive, and consequential damages, unless otherwise specified in writing.

To the maximum extent permitted by applicable law, our entire liability hereunder, for any reason whatsoever, shall be limited to the amount actually paid by you to us for the merchandise, Products, services and experiences available through the Website.

    All content available on or applicable to the Website, including but not limited to the trademarks, logos, collection, arrangement, assembly, presentation of pages, logos, text, images, feeds, graphics, videos, icons, software, headers and database (the “Content”), is the property of milia m and/or its affiliates, subsidiaries, or licensors, as the case may be, and are protected by intellectual property laws including without limitation by copyrights, trademarks, service marks, or other related laws. Users are prohibited from modifying, copying, distributing, transmitting, displaying, publishing, reproducing, selling, licensing, creating derivative works or using any Content for commercial or any public purposes.

    You shall be held liable for any infringement of the trademark and other intellectual property rights.

Any party or individual conducting unlawful activities on milia m will be reported to the proper authorities, including disclosure of personal information relating to any investigation of said activities.

  21. The Website may offer links to other independent third party websites. You acknowledge that we have no control over such websites and that we are not responsible for the accuracy, content, legality, or any other aspect of any independent third party website.

  28. APPLICABLE LAW AND DISPUTE RESOLUTION
